The Trump Administration Seeks Top Court Approval for State Guard Forces in the State of Illinois
On Friday, the government submitted an urgent appeal to the nation's highest court, seeking approval to send state guard troops to Illinois.
This move is part of a broader campaign to expand the homefront role of the troops in multiple cities run by Democrats.
Court Fight Over Military Presence
In an immediate request, the federal legal authorities pressed the judiciary to overturn a lower court ruling that had stopped the deployment of a few hundred military reserve troops to the greater Chicago.
The presiding judge had expressed skepticism about the administration's explanation for sending troops, challenging its rationale in given local conditions.
A appellate court upheld the previous order on Thursday, keeping the activation on pause while the court case continues.
Administration's Justifications
The federal legal representative, representing the White House, claimed in the latest petition that federal law enforcement have frequently been “intimidated and targeted” in Chicago and the neighboring town of Broadview.
This site is home to an Immigration and Customs Enforcement detention center.
The president has earlier dispatched state guard units to Chicago and Portland, Oregon, after earlier activations to Los Angeles, California, the city of Memphis, and the nation's capital.
The president has stated that armed forces involvement is needed to control demonstrations and bolster deportation efforts.
Ideological Resistance
Elected Democrats have strongly opposed the decision, claiming that the White House's statements are inflated and politically motivated.
They allege the president of abusing his executive power to retaliate against critics.
Judges have also expressed doubt about the government's portrayal of the situation.
Local leaders say that protests over immigration enforcement have been mostly modest and non-violent, contrasting with the administration's portrayal of “combat area” circumstances.
Statutory Grounds
At the core of the dispute is the administration's application of a national law authorizing the commander-in-chief to federalize the national guard only in cases of rebellion or when “powerless with the regular forces to carry out the laws of the nation”.
The White House argues that the troops are necessary to protect government buildings and personnel from activists.
Current Actions
Earlier this month, the White House took control of three hundred troops of the state guard of Illinois and directed additional Texas national guard personnel into the Illinois.
As state authorities condemned the action, the White House increased his statements, demanding the arrest of the mayor of Chicago and the governor of Illinois, each a Democrat, charging them of not managing to safeguard immigration officers.
State authorities and the city of Chicago together took legal action against the government to halt the activation.
On October 9, Judge April Perry, nominated by President Biden, handed down a preliminary order stopping the command.
